Agreement to Terms

By downloading, installing, or using the Orbit Game: Protect the Planet mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

License to Use

Netrium Technologies grants you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

You May:

• Download and install the App on your personal device(s)
• Use the App for entertainment purposes
• Share the App with others by directing them to the official App Store listing

You May Not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any commercial purpose without our written permission
• Attempt to gain unauthorized access to any part of the App
• Use the App in any way that violates applicable laws or regulations

Intellectual Property

The App and all of its content, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Netrium Technologies and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that could damage, disable, overburden, or impair the App
• Attempt to interfere with the proper working of the App
• Use any automated system to access the App
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NETRIUM TECHNOLOGIES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or free of viruses or other harmful components
• Warranties regarding the accuracy or reliability of any content obtained through the App

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NETRIUM TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of the App
• Any interruption or cessation of the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available through the App

Indemnification

You agree to defend, indemnify, and hold harmless Netrium Technologies and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Updates to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona and the United States, without regard to conflict of law provisions.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Entire Agreement

These Terms constitute the entire agreement between you and Netrium Technologies regarding the use of the App and supersede all prior agreements and understandings.

Apple App Store Additional Terms

The following terms apply to your use of the App obtained from the Apple App Store:

• These Terms are between you and Netrium Technologies only, not with Apple, and Apple is not responsible for the App and its content
• Apple has no obligation to provide maintenance and support services with respect to the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
